1. Acceptance
By accessing or using ZIZPER, you agree to these Terms & Conditions and applicable policies. If you do not agree, do not use the service.
2. Platform Purpose
ZIZPER provides preliminary AI-powered location and property decision-support tools. The service is not a property marketplace, broker, appraiser, law firm, engineering firm, financial adviser, insurer, surveyor, title company, or government authority.
3. Eligibility and Accounts
You must be legally able to enter a binding agreement. You are responsible for accurate account information, protecting credentials, and activity under your account.
4. Permitted Use
You may use ZIZPER for lawful property research and internal decision support in accordance with your subscription plan. You may not misuse the platform, attempt unauthorized access, interfere with service operation, scrape at harmful scale, bypass usage or feature limits, reverse engineer protected components, or use outputs to violate law or third-party rights.
5. Reports and Data Limitations
Reports may contain errors, omissions, delayed information, model assumptions, or incomplete coverage. Availability and accuracy vary by location and data provider. You must independently verify zoning, title, boundaries, flood risk, environmental conditions, taxes, permits, market values, rental rules, infrastructure, legal rights, and all other material facts.
6. No Guarantee
Scores, rankings, projections, summaries, recommendations, financial outputs, and AI-generated observations do not guarantee price appreciation, rental income, liquidity, development approval, financing, suitability, safety, or investment performance.
7. Subscriptions and Billing
Paid plans renew according to the billing cycle shown at purchase unless canceled. Taxes, currency conversion, payment provider rules, prorations, refunds, and plan changes may apply as disclosed during checkout or in the Billing area. Features, usage limits, and commercial-use rights depend on the subscription plan active on your account.
8. Commercial Use — Professional Plan
Commercial Use Included is a benefit of the ZIZPER Professional plan. While a qualifying Professional subscription remains active and subject to these Terms, Professional subscribers may use ZIZPER-generated reports and analysis as supporting material in their own commercial property research, internal business analysis, client discussions, and professional workflows.
Commercial Use is intended to support the subscriber's own professional services and business decision-making. It does not transfer ownership of the ZIZPER platform, software, report design, underlying datasets, models, branding, or intellectual property.
8.1 Permitted Professional Uses
- Using ZIZPER reports and analysis in internal commercial property research and business workflows.
- Discussing ZIZPER-generated findings with the subscriber's own clients as supporting decision-support material.
- Sharing eligible exported reports with clients or professional counterparties where the applicable plan and feature permissions allow export.
- Using ZIZPER analysis as one input within broader advisory, consulting, brokerage, development, acquisition, or investment-research workflows, subject to applicable law and professional obligations.
8.2 Commercial Use Restrictions
Commercial Use does not include, unless ZIZPER separately authorizes it in writing:
- Resale, redistribution, or sublicensing of raw ZIZPER data or datasets.
- Reselling, sharing, transferring, or sublicensing account access.
- Bulk extraction, automated scraping, or systematic collection of ZIZPER data for creation of a competing database, product, or service.
- White-labeling, rebranding, or presenting the ZIZPER platform itself as the subscriber's own technology or service.
- Representing a ZIZPER report as a licensed appraisal, survey, title report, engineering report, legal opinion, tax opinion, lending decision, zoning determination, or regulated investment advice.
- Removing required ZIZPER notices, disclaimers, attribution, or source information from reports where such notices are provided.
- Making guarantees to clients or third parties regarding investment performance, appreciation, rental income, development approval, market value, or returns based on ZIZPER outputs.
8.3 Free and Investor Plans
Free and Investor plans do not include the Commercial Use license. Those plans are intended for personal or internal investment research and decision support unless ZIZPER expressly states otherwise in writing.
8.4 Professional Responsibility
Professional subscribers remain solely responsible for how they use ZIZPER outputs in client or commercial work, including compliance with applicable laws, licensing rules, disclosure duties, professional standards, and independent verification requirements. Commercial Use does not make ZIZPER a party to the subscriber's client relationship.
9. User Content
You retain rights in information you submit. You grant ZIZPER the limited permission necessary to host, process, analyze, and display that content to operate and improve the service.
10. Intellectual Property
The platform, interface, software, branding, report design, models, and original content are owned by or licensed to ZIZPER. Except for the limited rights expressly granted under these Terms, including applicable Professional-plan Commercial Use rights, no ownership or intellectual-property rights transfer to users.
11. Third-Party Services
The service may depend on third-party maps, AI, analytics, payments, hosting, email, public datasets, and other providers. ZIZPER is not responsible for third-party outages, changes, data availability, or independent terms.
12. Suspension and Termination
We may restrict or terminate access for nonpayment, misuse, security risk, legal requirements, or material violation of these Terms. If a Professional subscription ends or is downgraded, Professional-only Commercial Use rights for new use of the service end with that entitlement, subject to any rights or obligations that survive under applicable law or these Terms.
13. Disclaimers
The service is provided on an “as available” basis to the maximum extent permitted by law, without warranties that it will be uninterrupted, error-free, complete, current, or suitable for a particular transaction, client engagement, or professional purpose.
14. Limitation of Liability
To the maximum extent permitted by law, ZIZPER will not be liable for indirect, incidental, special, consequential, exemplary, or investment losses arising from use of or reliance on the service, including commercial or client-facing use of ZIZPER outputs.
15. Indemnity
You agree to be responsible for claims arising from your unlawful use, misuse of Commercial Use rights, violation of these Terms, or infringement of third-party rights.
16. Changes
We may update these Terms, plan features, usage limits, or Commercial Use conditions from time to time. Continued use after an effective update constitutes acceptance where permitted by law. Material changes will be communicated as required by applicable law.
